Confidentiality and e-mail transmission 

All our emails contain confidential information and are intended solely for the use of the individual to whom it is addressed. E-mail transmission cannot be guaranteed to be secure or error-free as information could be intercepted, corrupted, lost, destroyed, arrive late or incomplete, or contain viruses. Polaris Reinsurance Solutions FlexCo cannot accept liability for any errors or omissions in the contents of a message, which may arise because of e-mail transmission.

Contract binding

Important: No employee is authorized to conclude any binding agreement on behalf of Polaris Reinsurance Solutions FlexCo with another party by e-mail without express written confirmation by at least one Authorised person. Polaris Reinsurance Solutions FlexCo accepts no liability for the content of such email, or for the consequences of any actions taken based on akin information provided, unless that information is subsequently confirmed in writing.

Misrepresentation

Any views or opinions presented in an e-mail are solely those of the author and do not necessarily represent those of the company. Employees of Polaris Reinsurance Solutions FlexCo are expressly required not to make defamatory statements and not to infringe or authorize any infringement of copyright or any other legal right by email communications. The company will not accept any liability in respect of such communication, and the employee responsible will be personally liable for any damages or other liability arising.

Note: If you have received an email in error, please return the material received to the sender and delete all copies from your system. Please note that disclosing, copying, distributing or taking any action in reliance on the contents of an email received is strictly prohibited.

Duty of disclosure

Every customer must be aware of the duty of disclosure in relation to insurance products and services and the severe consequences of its breach. The duty of disclosure under Austrian law is a duty of a person or entity to pass on to the insurer/reinsurer, all material information relating to the risk under consideration.

Therefore, it is your duty to disclose all material facts to insurer/reinsurer before the contract is concluded, at the time of any variation of the policy that can influence the insurance contract during the insurance period and upon renewal.

A material fact is a fact which may influence an insurer/reinsurer's judgment in their assessment of a risk, including its terms and pricing. If you are in any doubt as to whether a fact is material, we recommend that it be disclosed. Failure to disclose material facts may entitle insurers/reinsurers to avoid the policy from inception.

Liability (3rd party actions)

Polaris Reinsurance Solutions FlexCo will in the process of verification of insurance products or services in many cases use only the information supplied to it by third parties (insurance brokers, insurance companies etc). In that instance Polaris Reinsurance Solutions FlexCo does not accept responsibility for any damage due to incomplete, inadequate or misrepresented contents of insurance policies or services that had been sent or offered by the third parties. Furthermore, Polaris Reinsurance Solutions FlexCo also assumes no responsibility for any errors in the submitted various insurance documents, electronic messages or other information transmitted by the third parties. Polaris Reinsurance Solutions FlexCo also accepts no responsibility for any damage, loss or compensation resulting from the content, advice or other legal acts emitted by the third parties.

Comments, recommendations and other legal acts of Polaris Reinsurance Solutions FlexCo are not binding, as neither Polaris Reinsurance Solutions FlexCo nor its employees are involved in or responsible for the preparation of third-party insurance guarantee requests.

Important notice

In line with GewO and Professional Conduct Rules for Insurance Intermediaries we declare that:

  • Polaris Reinsurance Solutions FlexCo or any employee who is employed in the company does not have a direct or indirect holding, representing more than 10% of the share capital or voting rights in any insurance company 
  • no insurance company or its subsidiaries or parent company, directly or indirectly, has shares in the company, representing more than 10% of the share capital or voting rights in Polaris Reinsurance Solutions FlexCo.
